Welcome to Limitless BioWorks. The terms “we,” “us,” and “our” refer to Limitless BioWorks. Limitless BioWorks operates this website and online store, including related information, content, features, tools, products, and services (collectively, the “Services”). Our online store is powered by Shopify, which provides the ecommerce platform used to make the Services available to you.

These Terms of Service, together with any policies referenced herein, describe the terms that apply when you access, browse, interact with, or purchase through the Services.

Please read these Terms carefully. They contain important information regarding your rights and responsibilities, including warranty disclaimers, limitations of liability, research-use restrictions, and other legal provisions.

By accessing or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use the Services.

SECTION 2 - RESEARCH USE ONLY
All products offered by Limitless BioWorks are sold strictly for laboratory research, analytical, educational, and other lawful non-clinical research purposes only.

Products are not intended for human or animal consumption, medical use, therapeutic use, diagnostic use, food use, cosmetic use, household use, or use as dietary supplements, drugs, biologics, pharmaceuticals, or veterinary products.

By purchasing from Limitless BioWorks, you represent and warrant that you understand the stated research-use restrictions and will use the products only for lawful research purposes consistent with their labeling and descriptions.

You are solely responsible for determining whether possession, purchase, handling, storage, transport, or use of any product is lawful and appropriate in your jurisdiction and for your intended research purpose.

Limitless BioWorks does not provide medical advice, treatment recommendations, dosing instructions, diagnostic guidance, or instructions for human or animal use.

SECTION 3 - PRODUCT INFORMATION
We make reasonable efforts to accurately display and describe the products offered through the Services. Product photographs, packaging, labels, colors, and other visual representations may differ slightly from the product received due to device settings, packaging updates, production changes, or other factors.

Product descriptions, specifications, availability, pricing, packaging, batch information, testing information, and related content may be updated or changed without prior notice.

We reserve the right to discontinue products, change product specifications, limit quantities, or restrict product availability by customer, geographic region, jurisdiction, or other criteria where appropriate.

Any analytical results, certificates, testing documentation, batch information, or other technical information made available through the Services is provided for research and informational purposes only and should be interpreted within the scope and limitations of the applicable testing method.

SECTION 4 - ORDERS AND ORDER ACCEPTANCE
Submitting an order through the Services constitutes an offer to purchase the products listed in your order.

Limitless BioWorks reserves the right to accept, reject, hold, limit, modify, or cancel an order for any lawful reason, including product availability, suspected fraud, payment issues, pricing errors, shipping restrictions, compliance concerns, or suspected violation of these Terms.

An automated order confirmation does not necessarily constitute final acceptance of an order. An order may be considered accepted only after payment is received or authorized and the order is approved for processing.

Please review your order carefully before submission. We will make reasonable efforts to accommodate cancellation requests submitted before fulfillment begins, but we cannot guarantee that an order can be modified or cancelled once processing has started.

Returns, refunds, replacements, and exchanges are governed by our Refund Policy.

SECTION 5 - PRICING, DISCOUNTS, AND PROMOTIONS
Prices, discounts, promotional offers, volume discounts, coupon codes, shipping thresholds, and other promotional terms are subject to change without prior notice unless otherwise required by law.

The price charged for a product will generally be the price shown at the time your order is placed, subject to correction of pricing, typographical, technical, or system errors.

Unless otherwise stated, displayed prices do not include applicable taxes, shipping charges, customs duties, import charges, payment-processing charges, blockchain network fees, or similar third-party costs.

Promotional codes, volume discounts, and other offers may have separate eligibility requirements and may or may not be combinable. Where a promotion contains separate terms, those promotion-specific terms will control in the event of a conflict with these Terms.

Limitless BioWorks reserves the right to correct pricing errors and cancel or modify orders affected by obvious pricing, discount, or system errors.

SECTION 6 - PAYMENT
You agree to provide accurate and complete payment information and represent that you are authorized to use the selected payment method.

Available payment methods may include credit or debit card payments, invoice-based payments, Zelle, Cash App, cryptocurrency, or other methods shown during checkout or otherwise provided for a specific order.

Orders are not processed for fulfillment until payment has been received, authorized, and confirmed as applicable.

For manual or cryptocurrency payments, you are responsible for following the exact payment instructions provided, including the correct amount, recipient information, token, blockchain network, and wallet address.

Limitless BioWorks is not responsible for funds lost as a result of a customer sending payment to an incorrect address, incorrect account, incompatible blockchain network, or using an incorrect token when the payment information provided by Limitless BioWorks was accurate.

SECTION 7 - SHIPPING AND DELIVERY
Shipping and delivery dates are estimates only and are not guaranteed.

Limitless BioWorks is not responsible for delays caused by carriers, weather, natural disasters, customs processing, government actions, service interruptions, incorrect customer-provided addresses, or other events outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. Additional costs resulting from an incorrect, incomplete, or undeliverable address may be the responsibility of the customer.

Issues involving damaged, missing, incorrect, lost, or undelivered shipments are subject to our Refund Policy and applicable carrier procedures.

SECTION 8 - RETURNS AND REFUNDS
Returns, replacements, refunds, damaged-product claims, missing-item claims, order cancellations, and related matters are governed by our Refund Policy.

Products that have been opened, unsealed, used, altered, reconstituted, improperly stored, contaminated, or otherwise compromised may not be eligible for return.

Refunds, where approved, are limited to amounts actually paid after applicable discounts, credits, promotional adjustments, and other reductions.

SECTION 9 - INTELLECTUAL PROPERTY
The Services and their contents, including text, product photography, graphics, designs, logos, trademarks, service marks, videos, audio, layout, website design, product descriptions, proprietary graphics, and other materials, are owned by or licensed to Limitless BioWorks and are protected by applicable intellectual property laws.

You may use the Services only for lawful personal, business, or research-related informational purposes consistent with these Terms.

You may not reproduce, copy, republish, distribute, modify, scrape, extract, sell, commercially exploit, create derivative works from, or publicly display proprietary content from the Services without prior written permission, except where such restriction is prohibited by law.

Limitless BioWorks names, logos, product names, designs, slogans, branding, and related marks may not be used without prior written authorization.

SECTION 10 - THIRD-PARTY SERVICES AND LINKS
The Services may contain links to third-party websites, services, payment processors, laboratories, analytics providers, shipping carriers, applications, or other third-party resources.

Limitless BioWorks does not control and is not responsible for the content, availability, privacy practices, terms, security, accuracy, or performance of third-party services.

Your use of third-party services is subject to the applicable third party's own terms and policies.

SECTION 11 - RELATIONSHIP WITH SHOPIFY
Limitless BioWorks uses Shopify to provide ecommerce infrastructure for the Services. Purchases made through the Limitless BioWorks store are transactions directly between you and Limitless BioWorks.

Shopify is not the seller of Limitless BioWorks products and is not responsible for product quality, fulfillment, shipping, returns, refunds, customer service, or other aspects of transactions between you and Limitless BioWorks, except to the extent Shopify independently provides services under its own terms.

SECTION 12 - PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Services are hosted through Shopify and may use third-party service providers, certain information may also be processed by Shopify and other service providers as necessary to operate the Services, process transactions, detect fraud, provide customer support, and perform related functions.

SECTION 13 - REVIEWS, FEEDBACK, AND USER CONTENT
If you submit reviews, comments, photographs, suggestions, feedback, testimonials, ideas, or other content to Limitless BioWorks, you represent that you have the right to provide such content and that it does not violate any applicable law or third-party right.

To the extent permitted by law, you grant Limitless BioWorks a worldwide, non-exclusive, royalty-free license to use, reproduce, publish, display, adapt, and distribute such content in connection with operating, improving, or promoting the Services.

We may remove or decline to publish content that we reasonably believe is unlawful, misleading, defamatory, abusive, infringing, fraudulent, obscene, or otherwise inappropriate.

You remain responsible for the accuracy and legality of content you submit.

SECTION 14 - ERRORS, INACCURACIES, AND OMISSIONS
The Services may occasionally contain typographical errors, technical errors, inaccuracies, outdated information, or omissions relating to product descriptions, pricing, availability, discounts, promotions, shipping information, testing information, or other content.

We reserve the right to correct errors, update information, modify listings, or cancel affected orders at any time where permitted by law.

  • scrape, systematically extract, copy, or commercially exploit substantial portions of the Services without authorization; or
  • use the Services in any manner that could damage Limitless BioWorks, Shopify, our service providers, customers, or third parties.

We reserve the right to refuse service, cancel orders, restrict access, or terminate accounts where we reasonably believe these Terms have been violated.

SECTION 16 - DISCLAIMER OF WARRANTIES
Information provided through the Services is made available for general research, product, commercial, and informational purposes only.

Limitless BioWorks does not warrant that information on the Services will always be complete, current, error-free, uninterrupted, or suitable for a particular research application.

EXCEPT TO THE EXTENT EXPRESSLY REQUIRED BY APPLICABLE LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR OTHER WARRANTIES THAT MAY OTHERWISE ARISE BY LAW.

Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be excluded or limited.

SECTION 17 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LIMITLESS BIOWORKS AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR SIMILAR LOSSES ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, LIMITLESS BIOWORKS' AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO A PARTICULAR ORDER SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID TO LIMITLESS BIOWORKS FOR THE PRODUCTS GIVING RISE TO THE CLAIM.

These limitations apply only to the extent permitted by applicable law.

SECTION 18 - CUSTOMER RESPONSIBILITY AND ASSUMPTION OF RISK
You are responsible for ensuring that products are handled, stored, transported, analyzed, and used appropriately for lawful research purposes.

You acknowledge that research materials may require specialized knowledge, equipment, storage conditions, laboratory procedures, and safety precautions.

Limitless BioWorks is not responsible for loss, damage, contamination, degradation, analytical error, misuse, improper storage, improper handling, or other consequences arising after delivery where such issues result from circumstances outside our control.

SECTION 19 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Limitless BioWorks and its affiliates, owners, officers, employees, contractors, agents, licensors, service providers, and Shopify from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from your violation of these Terms, violation of applicable law, infringement of third-party rights, or misuse of the Services or products.

SECTION 20 - TERMINATION
We may suspend or terminate access to the Services, cancel pending orders, or restrict future transactions where permitted by law, including where we reasonably believe there has been fraud, abuse, prohibited use, legal noncompliance, or violation of these Terms.

Provisions that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, disclaimers, liability limitations, indemnification, governing law, and dispute-related obligations.

SECTION 21 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

SECTION 22 - WAIVER AND ENTIRE AGREEMENT
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

These Terms, together with the policies and other terms incorporated by reference, constitute the agreement governing your use of the Services and supersede prior versions relating to the same subject matter.

SECTION 23 - ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without prior written consent from Limitless BioWorks.

Limitless BioWorks may assign or transfer its rights or obligations in connection with a merger, acquisition, sale of assets, restructuring, change of control, service-provider relationship, or other lawful business transaction.

SECTION 24 - GOVERNING LAW AND VENUE
These Terms and your use of the Services will be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.

To the extent a dispute may lawfully be subject to exclusive venue, you agree that such dispute may be brought in the appropriate state or federal courts located in Florida, subject to applicable jurisdictional requirements.

We may update or modify these Terms from time to time by posting a revised version through the Services.

Where required by law, material changes will be accompanied by appropriate notice. Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
